No Indirect Damages: To the fullest extent permitted by law, Code Artists LLC, its members, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to lost profits, loss of business opportunities, data loss, or reputational harm, even if advised of the possibility of such damages.
Cap on Liability: The maximum liability of Code Artists LLC for any claim arising out of or related to its services, software, or agreements shall not exceed the amount paid by the client in the last 12 months for the specific service or software in question.
No Warranty Disclaimer: Code Artists LLC provides all software and services on an "AS-IS" and "AS-AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The client assumes all risks associated with software usage.
Force Majeure: Code Artists LLC shall not be liable for any failure or delay in performance due any circumstances, such as bugs, incorrect documentation, hardware failures or problems of any sort. Code Artists LLC is not responsible for any circumstances under its control or beyond its reasonable control, including but not limited to acts of nature, cyberattacks, third-party service failures, or government actions.
